participation, photo release, waiver of liability and release/indemnity/hold harmless agreement
Event: BOLT Student Leadership Program
Date and Location of Event: June 22-June 25, 2025 / Walt Disney World, Orlando FL
In this document, “Agreement” means this entire Permissions, Expectations, Release, and Hold Harmless Agreement. “Event” refers to all the activities associated with and/or incidental to attending the Event indicated above, including travel to/from/during the Event (including air travel). The undersigned executing this Agreement is voluntarily participating in the Event and hereby assumes all risks for the undersigned and/or undersigned’s child/student participating in this Event, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the Released Parties (listed below), from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. As the undersigned, I acknowledge that this Agreement will be used by the event holders, sponsors, and organizers of the Event in which I and/or my child/student and/or any other individual accompanying us may attend, and that it will govern actions and responsibilities at said Event.
I certify that I and/or my child/student is physically fit, has been sufficiently prepared for participation in Event, and has not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my or my child’s/student’s participation in this Event. I acknowledge that this Event may involve a test of a person’s physical and mental limits. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, event officials, and event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to participants but are also present for facilitators, chaperones, and volunteers.
I hereby consent for me and/or my child/student to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during this activity or event. If medical treatment is needed as a result of participation in this activity or event, travel to and from the activity or event (including air travel), or any activity incidental to this event, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware that there is no health insurance coverage associated with this event or activities and that I should carry my own health insurance.
By attending this Event and related activities, it is acknowledged that I, my child/student, and/or any other individuals who accompany us may be photographed. We consent to any such photo and/or video, and on behalf of myself, my child/student, and/or any other individuals accompanying me, I agree to allow any photo or video to be used for any legitimate purpose by the event holders, organizers, sponsors, and assigns. I agree that Pegasus Springs Education Collective (PSEC) has the right to digitize, post, publish, distribute, or exhibit such photos/videos in any media (for instance, including without limitation, in print, electronic media, newsletters, brochures, website, social media, etc.) for any and all purposes. It is also agreed that PSEC shall have the full, exclusive and complete ownership of said material produced pursuant to this release and shall be deemed the sole property of PSEC. I, my child/student, and/or any other individuals who accompany us hereby waive any right of inspection or approval for the use of my/our likeness in any photo/video; understand that I/we have no right or claim to any royalty, payment, or other compensation arising out of or in connection with use of any photo/video; and hereby release, hold harmless, and forever discharge the Released Parties from any and all claims, actions, suit, or demands of any kind whatsoever arising out of or in connection with any use hereunder including without limitation any claims of defamation, harm, costs, invasion of privacy, or infringement of moral rights, rights of publicity and/or copyright. It is agreed as well that this release shall be binding upon my/our heirs, legal representatives, and assigns.\
I acknowledge that the Released Parties (named below) are NOT responsible for lost or stolen personal items while participating in the Event—or any errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of the released parties.
I acknowledge that participation in this event could create exposure to viruses, illnesses, or other health risks. I acknowledge that an inherent risk of exposure to the disease COVID-19 (as defined by the World Health Organization and any strains, variants, or mutations thereof) and SARS-CoV-2 (the virus that can cause COVID-19) (collectively, “COVID-19”), and any other communicable or infectious disease, exists in any public place where people are present. “Communicable disease” means any disease or illness caused by microorganisms such as bacteria, viruses, parasites, or fungi that can be spread, directly or indirectly, from one person to another. “Infectious disease” means any disease or illness caused by microorganisms such as bacteria, viruses, parasites, or fungi that enter the body, multiply, and can cause an infection. COVID-19 is an extremely contagious communicable disease that can lead to severe illness and death. No precautions can eliminate the risk of exposure to COVID-19, and the risk of exposure applies to everyone. I acknowledge that the risk of exposure to COVID-19 and any other communicable or infectious disease includes the risk that I will expose others that I later encounter, even if I am not experiencing or displaying any symptoms of illness myself. By attending/participating in this event, all registrants and attendees agree to voluntarily assume any and all risks in any way related to exposure to COVID-19 and any other communicable or infectious disease, including illness, injury, or death of myself or others, and including without limitation, all risks based on the sole, joint, active or passive negligence of any of the Released Parties. I acknowledge that health risks may be present and that participation by all attendees and registrants is entirely voluntary.
I understand and agree that if an attendee begins to have Covid or flu-like symptoms during the event, that the attendee must notify chaperones and event organizers, and may need to refrain from sessions so as to not infect any other participants or venue guests. (COVID rapid-test kits and face masks will also be available if needed or requested.) I also understand and agree that for everyone’s safety, continued participation in the event requires that attendees adhere to all guidelines and expectations of both the event coordinators and the event venue. On my own behalf and on behalf of my heirs, executors, representatives, administrators, and assigns, I agree to indemnify and hold each of the Released Parties harmless from and against any and all claims made or incurred by anyone, including myself, my child/student, and any individual who uses a registration, ticket, or reservation made by me, including exposure to any illness or any other health risk for an individual, arising out of or in any way relating to participation in this event and/or stay at the venue.
I understand that in order to participate in this event, all registrants must behave in a way that ensures a safe and enjoyable experience for all attendees. Registrants must follow the Walt Disney World Resort Property Rules. Registrants and event attendees also are indicating understanding and agreement with this full BOLT Release/Indemnity/Hold Harmless Agreement and the Walt Disney World Resort’s Terms & Conditions with COVID-19 liability waiver.
In consideration of the entire above agreement, my and/or my child’s/student’s registration, attendance, and my permitting participation in this event, and on my own behalf and on behalf of my heirs, next of kin, executors, personal representatives, administrators, and assigns, I hereby take action as follows:
(A) I HEREBY WAIVE, RELEASE, AND DISCHARGE the Released Parties from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my own, for any individuals’ accompanying me, and/or for my child’s/student’s death, disability, illness, health complication, personal injury, property damage, property theft, loss, or actions of any kind which may during or hereafter occur to me/us including traveling to and from this event.
(B) I HEREBY INDEMNIFY, PROMISE NOT TO SUE, and HOLD HARMLESS the Released Parties (listed below) from any and all loss, damage, cost, and liabilities or claims made or incurred by anyone (including my child/student or anyone accompanying me who uses a reservation, registration, or ticket arranged by me) as a result of attendance/participation in this Event (including any theft, loss, property damage, personal injury, illness, health complication, disability, or death arising out of or in any way relating to participation in this event and/or stay at the venue). Wherever the activities may occur, whether caused by the negligence of release or otherwise, and whether suffered before, during, or after participation in the event, I agree to hold all Released Parties harmless from any and all claims, loss or damage to person, personal property, liabilities and costs, including attorney’s fees, as a result of attending/participating in the Event, including travel to/from/during the Event (including air travel).
Released Parties: The released parties for this agreement are Pegasus Springs Education Collective and partnering organizations — including their respective officers, directors, representatives, employees, contractors, subcontractors, coordinators, group leaders, volunteers, successors, assigns, insurers, and agents.
This release, waiver of liability, and the assumption of risk set forth above is intended to be as broad and inclusive as is permitted by law.
Each registrant’s parent or legal guardian will also be provided a copy of this agreement to sign. Parents/guardians must also complete an emergency contact & medical form for each student’s participation.
